Please read these Terms and Conditions (“Terms”) carefully before using Reserve.hr (“the platform”) operated by Reserve.hr (“us”, “we”, or “our”). These Terms govern your access to and use of the platform and the services provided through it.
1. Acceptance of Terms
By accessing or using Reserve.hr, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you may not use the platform. These Terms constitute a legal agreement between you and Reserve.hr.
2. Use of the Platform
2.1 Eligibility: You must be at least 18 years old or have the legal capacity to enter into a binding contract to use Reserve.hr. By using the platform, you represent and warrant that you meet these requirements.
2.2 Account Registration: To access certain features of Reserve.hr, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 Prohibited Conduct: When using Reserve.hr, you agree not to engage in any conduct that:
a) Violates any applicable laws, regulations, or third-party rights;
b) Interferes with or disrupts the functionality of the platform;
c) Attempts to gain unauthorized access to the platform or other user accounts;
d) Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity;
e) Uses automated systems or software to access or extract data from Reserve.hr without our prior written permission;
f) Harasses, threatens, or abuses other users of the platform; g) Engages in any fraudulent, deceptive, or misleading activities.
3. Content
3.1 User-Generated Content: Reserve.hr allows users to submit content, such as listings, reviews, and comments. By submitting content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the platform.
3.2 Prohibited Content: You agree not to submit any content that:
a) Infringes or violates the rights of any third party, including intellectual property, privacy, or publicity rights;
b) Contains defamatory, obscene, or offensive material;
c) Contains viruses, malware, or other harmful code;
d) Promotes or facilitates illegal activities.
We reserve the right to remove or modify any content that violates these Terms or is otherwise objectionable.
4. Intellectual Property
Reserve.hr and its contents, including but not limited to the platform’s design, graphics, logos, trademarks, and software, are the property of Reserve.hr and are protected by intellectual property laws. You may not use, reproduce, modify, or distribute any portion of the platform without our prior written consent.
5. Limitation of Liability
To the fullest extent permitted by law, Reserve.hr and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from:
a) Your use or inability to use the platform;
b) Any content or conduct of any third party on the platform;
c) Unauthorized access, use, or alteration of your data.
6. Modification and Termination
We reserve the right, at our sole discretion, to modify or terminate Reserve.hr, or any part thereof, at any time without prior notice. We may also modify these Terms from time to time, and such modifications shall
be effective immediately upon posting on Reserve.hr. Your continued use of the platform after any modifications to the Terms indicates your acceptance of the modified Terms.
7. Indemnification
You agree to indemnify and hold Reserve.hr and its affiliates, officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with:
a) Your use of the platform;
b) Your violation of these Terms;
c) Your violation of any third-party rights;
d) Your interaction with other users of Reserve.hr.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Croatia, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of Reserve.hr shall be exclusively brought in the courts located in Croatia, and you consent to the personal jurisdiction of such courts.
9. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intention and economic effect of the original provision.
10. Entire Agreement
These Terms constitute the entire agreement between you and Reserve.hr concerning the use of the platform, superseding any prior or contemporaneous agreements, communications, and understandings, whether oral or written.
